Il difficile rapporto tra ‘centro’ e ‘periferia’ nella devolution scozzese

ABSTRACT

 

Il 17 gennaio 2023, il Segretario di Stato per la Scozia Jack Alister ha emanato un order ai sensi della Section 35 dello Scotland Act 1998, vietando di presentare il Gender Recognition Reform (Scotland) Bill per il Royal Assent ai fini della sua promulgazione. Si è trattato della prima applicazione dei poteri attribuiti al governo britannico in relazione al ‘controllo’ sulla legislazione scozzese approvata nell’ambito delle competenze devolute. Successivamente alla contestazione per via giudiziale di tale order, la Outer House della Court of Session, in data 8 dicembre 2023, ha emesso la decisione Re Scottish Minister’s Petition, attraverso la quale è stato riconosciuto come legittimo, nel quadro della devolution scozzese, l’utilizzo del disposto della Section 35. Il presente contributo intende approfondire le implicazioni sottese all’esercizio di tale potere nei rapporti tra ‘centro’ e ‘periferia’, così come il ruolo che possono giocare le corti nella gestione di tali rapporti.

 

 

On 17 January 2023, Secretary of State for Scotland Jack Alister issued an order under Section 35 of the Scotland Act 1998, prohibiting the submission of the Gender Recognition Reform (Scotland) Bill to the Royal Assent for enactment. This was the first application of the UK government’s powers in relation to ‘control’ over Scottish legislation passed within the devolved powers. Following the judicial challenge to this order, the Outer House of the Court of Session, on 8 December 2023, issued the decision Re Scottish Minister’s Petition, through which the use of Section 35 was recognised as legitimate under Scottish devolution. This paper seeks to explore the implications of the exercise of this power in the relationship between the ‘centre’ and the ‘periphery’, as well as the role that the courts can play in managing these relationships.
